What's Causing the Disposable Vape Shortage
Customs and Border Protection (CBP) has ramped up enforcement on vape product imports in a major way. Large shipments of disposable vapes — some containing millions of units — are being seized at U.S. ports of entry before they ever reach distributors or retail shelves.
In May 2026, CBP launched Operation Red Mist alongside federal partners, resulting in the seizure of millions of illegal e-cigarettes in maritime cargo shipments. Just a year earlier, in May 2025, a joint FDA and CBP operation in Chicago seized nearly two million units of unauthorized e-cigarette products with an estimated retail value of $33.8 million. The FDA noted that almost all of the seized shipments originated in China and used vague product descriptions and incorrect values in apparent attempts to dodge import screening. In a separate action, CBP officers in Chicago made 121 seizures of over 3.2 million prohibited Electronic Nicotine Delivery Systems valued at $81.5 million.
This isn't a random crackdown. It's the downstream effect of years of regulatory pressure from the FDA and state agencies, finally colliding with the reality of how most vape products enter the country.
Here's the Short Version of Why It's Happening
FDA Marketing Authorization Requirements
Under the Tobacco Control Act, any new tobacco or nicotine product has to receive a Premarket Tobacco Product Application (PMTA) approval before it can legally be sold in the U.S. According to the FDA, the vast majority of e-cigarette products currently on the market — especially from overseas manufacturers — never went through that process. The FDA's own enforcement actions page confirms that the agency is actively pursuing unauthorized products, including through seizures and warning letters to distributors.
Flavored Vape Bans
California's SB 793 — signed into law in 2020 and enforced starting in December 2022 — banned the sale of most flavored tobacco and vape products statewide, per the California Attorney General's office. Other states have passed similar restrictions. Products that don't comply with these laws are being flagged and held, sometimes in bulk, before they even reach retail.
Counterfeit and Unlicensed Product Seizures
A significant portion of what's being seized involves counterfeit versions of popular brands — products manufactured overseas and sold under well-known names without authorization. The FDA and CBP have specifically called out misbranded and mis-manifested shipments as a priority target. CBP has noted that seized shipments frequently contain undervalued and mislabeled goods intended to slip past inspection.
Vape Supply Chain Disruptions
Even products that eventually clear customs are getting caught in backlogs. The increased scrutiny means longer inspection timelines, delayed releases, and logistical bottlenecks that ripple all the way down to the retail level.
